1. Acceptance of Terms

Welcome to figma2code ("we," "us," or "our"). We are a company operating under the laws of the applicable jurisdiction. These Terms of Service ("Terms") govern your access to and use of our AI-powered design generation platform, accessible at https://figma2code.tech (the "Service").

By creating an account, purchasing credit packs, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

⚠️ Important: If you do not agree to these Terms, do not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of Service

figma2code provides an AI-powered platform that transforms hand-drawn sketches and text descriptions into Figma prototype designs. The Service is a digital Software-as-a-Service (SaaS) product delivered over the Internet.

2.1 Nature of Service

The Service is a digital, intangible product. Access is granted immediately upon payment confirmation. Due to the immediate delivery nature of digital services, refunds are subject to specific limitations outlined in Section 7.

2.2 AI Model Dependencies

Our Service relies on third-party AI model providers, including:

• Alibaba Cloud (Qwen) – AI vision recognition and design generation
• DeepSeek – AI code interpretation and design processing

The performance and availability of our Service may be affected by these third-party providers. Significant service interruptions will be communicated to users promptly. We do not guarantee specific output quality from AI models.

3. Account Registration

To use our Service, you must:

• Create an account with accurate, complete information
• Maintain the confidentiality of your login credentials
• Be at least 18 years old (or have parental consent)
• Not share your account with others

3.1 Account Security

• Report unauthorized access immediately to security@figma2code.tech
• Do not share login credentials with any third party
• Ensure your registered billing email remains valid

3.2 Enterprise Accounts

If you are registering on behalf of a company or organization, you confirm that you are authorized to bind that entity to this agreement.

4. Credit Packs & Plans

Our Service uses a credit-based system. Credit packs are one-time purchases that grant you a set number of AI design generations. Current available credit packs and pricing are listed at /pricing.

We reserve the right to modify plan features or introduce new plans at any time. Price changes follow Section 5.2.

5. Billing & Payment

5.1 Single Purchase Authorization

Each credit pack purchase is a one-time transaction. Completing a purchase authorizes figma2code to charge your provided payment method for the amount displayed at checkout.

5.2 Price Changes

We will provide at least 30 days advance notice before any price changes take effect. Price changes will be communicated via email or platform notice.

5.3 Taxes

Unless otherwise stated, all listed prices exclude applicable taxes (including VAT, GST, sales tax, etc.). Where required by applicable law, we will collect and remit such taxes.

6. Credit Expiration & Account Termination

6.1 Credit Validity

Purchased credits are valid for 30 days from the date of purchase. Unused credits expire at the end of the 30-day period and are non-refundable. We will send reminder notifications before credits expire.

6.2 Account Termination

If your account is terminated (whether by you or us), unused credits will be retained for 30 days after termination. After this period, unused credits will expire and will not be refunded unless required by applicable law.

7. Refund Policy

Used credits are not eligible for refunds. Exceptions are granted in the following cases:

• Within 7 days of purchase, credits unused: Full refund available
• Duplicate charges: Full refund for any billing errors
• Statutory rights: EU/UK 14-day withdrawal right is preserved for first-time purchasers; lapses after first use

To request a refund, email refunds@figma2code.tech with your account email and transaction ID. We aim to confirm receipt within 2 business days and process eligible refunds within 5–10 business days.

8. Billing Disputes

If you believe a charge is incorrect, please contact us at billing@figma2code.tech before initiating a dispute with your bank or credit card company. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content & Intellectual Property

9.1 Output Content Ownership

Subject to these Terms, AI-generated designs ("Output Content") created from your inputs belong to you. You may use Output Content for any lawful purpose consistent with Section 10.

9.2 Input Content License

By submitting sketches, prompts, or other content ("Input Content") to our Service, you grant figma2code a limited, non-exclusive license, used solely to provide the Service to you. We will not use your Input Content for AI model training without your explicit consent.

9.3 AI Output Accuracy

AI-generated content may contain errors, inaccuracies, or outdated information. You are responsible for reviewing and verifying output content before relying on it, particularly for professional or commercial use.

10. Acceptable Use Policy

You agree to use the Service only for lawful purposes. Prohibited uses include:

• Generating illegal, defamatory, harassing, or fraudulent content
• Generating, distributing, or assisting in the creation of Deepfake content
• Generating content that sexualizes or exploits minors
• Creating malware, phishing content, or cyberattack tools
• Infringing third-party intellectual property or privacy rights
• Bypassing or interfering with Service security features
• Reselling or sublicensing access without prior written approval
• Violating applicable laws, regulations, or card network rules

10.1 AI-Specific Prohibitions

• Using Service inputs, outputs, or derivatives to train competing AI/ML models
• Large-scale systematic scraping of model outputs beyond authorized personal use
• Presenting AI-generated content as the work of licensed professionals (doctors, lawyers, financial advisors)

11. Data, Privacy & Security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by Waffo Pancake (PCI-DSS compliant) and is never stored on our servers. Account data is retained for 90 days after account deletion, then deleted per our Privacy Policy.

12. Disclaimers & Limitation of Liability

12.1 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or AI output accuracy.

AI-generated content may be inaccurate, incomplete, or outdated. Do not rely on it for legal, medical, financial, or other professional advice. Always verify with a qualified professional before taking action based on AI-generated content.

12.2 Limitation of Liability

To the maximum extent permitted by applicable law, figma2code is not liable for any indirect, incidental, consequential, special, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

13. Term & Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate accounts for serious violations, suspected fraud, or legal requirements. If we terminate without cause, we will prorate-refund unused prepaid credits. You may delete your account at any time by contacting support@figma2code.tech.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the applicable jurisdiction. Before initiating formal proceedings, please contact us at legal@figma2code.tech to seek informal resolution. Unresolved disputes shall be subject to the jurisdiction of the courts in the applicable jurisdiction.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email or platform notice. Continued use after changes constitutes acceptance of the revised Terms. If any provision is found invalid, the remaining provisions remain fully effective. These Terms, together with the Privacy Policy, constitute the complete agreement between you and figma2code.
